:cool:I own a BYOB memebers only Swingers Club in Houston and I was thinking of throwing some alcohol based theme parties. So this is where it gets tricky. Can I give away drinks and still be considered a BYOB in houston, tx??? Or does anyone know any tricks to pull this off???

Tricks are for kids......Don't try and fool your Liquor Control People. They've seen it all and love it when people try and pull the wool over their eyes.

<p>Ok in TEXAS! Selling Liquor without a license is HIGHLY ILLEGAL! IT is really not that hard to get a Mixed Beverage Permit now anyway. AND, you CAN give it away to your friends as long as there is NO monetary GAIN for You. If you have a &quot;Cover charge&quot; monthly membership or some such &quot;Gain&quot; you are in violation of section 103 TABC and will go to JAIL!</p> <p>&nbsp;</p> <p>I know this because they arrested me in my HOME having a public/private PARTY! IT cost me dearly before it was all finished. Now, I study the Their code and know it as well as many of their officers.</p> <p>&nbsp;</p> <p>If you are drinking YOUR booze and just want to give a friend a shot because you want to help celebrate a birrthday or such event, Then you have a legal right to do so. </p> <p>&nbsp;</p> <p>If you have kegs out and are serving beers to everyone who comes in for absolutely free AND you have no type of Monetary inducement AND are not asking for TIPS, Cover, memberships or any other thing then you can pass muster w/TABC. If you are doing this you must be able to provide the same beverage to any Tom, Dick or Harry that just happens to come in(Provided age 21, of course.... NEVER SERVE MINORS IN PUBLIC).</p> <p>&nbsp;</p> <p>Now, that bum or that great looking person who comes in and requests the free drinks... that you are giving away... You MUST also make the beverages available to them as well. (THAT just be the TABC decoy tht busts you) DO NOT solicit anything from that person. Give them the drink and be happy. IF you try to run them off or induce them or even seduce them, You will GET BUSTED!</p> <p>&nbsp;</p> <p>Now, all that.. a Wine/Beer on premise permit is less than a grand in Texas. Amixed beverage with late hours permit is around 10Grand now. Get a Wine/beer on premise. its under a grand for the license. Then you can legally sell at least that. The patrons can still bring in thier own BYOB and you sell "Set-ups" You as a "Patron" can still give away your booze to friends as you see fit.

Your name is clubforbidden. Are you a "Club" as in a group of associated individuals? OR do you actually have an established location for on-premise "activities"?

You got my curiosity going. How in the state of Texas can you SELL liquor without a license?

TABC arrested me in my private apt for "Selling" w/o a license. All I was doing is asking my party guests to "contribute" to what they were drinking and that was enough to get me busted. (Granted my party was larger than most clubs have, but it was still in my residence)

So, do you have a loophole? I would LOVE to find a way around 14% retail taxes. I have to pay more in Taxes for a bottle of liquor than the bottle itself.
